Acceptance of these terms.

These Terms of Service form a binding agreement between you and WeBuyTools.com (“WeBuyTools,” “we,” “us,” or “our”). If you do not agree to these terms, do not use the website or services.

Additional policies displayed on the website, including our Privacy Policy, Shipping Policy, and Return and Refund Policy, are incorporated into these terms by reference.

Eligibility and legal capacity.

You must be at least 18 years old and legally able to enter into a binding agreement to submit tools for sale, make a purchase, or use transaction-related services.

If you use WeBuyTools on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms.

Accounts and information.

You are responsible for providing current, complete, and accurate information and for keeping your account credentials confidential.

You are responsible for activity performed through your account unless you promptly notify us that the account has been accessed without authorization.

We may request additional information to confirm identity, ownership, payment details, shipping information, or transaction legitimacy.

Submitting a seller order.

When submitting tools to WeBuyTools, you must accurately identify each tool, select the correct model and condition, disclose material defects, and identify the batteries, chargers, cases, accessories, or other items included.

Prices shown on the website are preliminary offers based on the information selected or provided. Submitting an order does not require WeBuyTools to purchase any item before inspection and final approval.

We may reject, cancel, combine, separate, or request clarification regarding an order when information is incomplete, inaccurate, inconsistent, or cannot be verified.

Declining a revised offer.

If WeBuyTools provides a revised offer after inspection and you decline it, you may request the return of the affected item or items.

If return shipping is not arranged within a reasonable time after notice, WeBuyTools may, where permitted by law, charge reasonable storage fees, dispose of the items, or take other action consistent with our Return and Refund Policy.

Shipping and risk.

You are responsible for packaging tools securely, following carrier rules, using accurate package dimensions and weight, and excluding prohibited or undeclared hazardous materials.

Shipping labels supplied by WeBuyTools may only be used for the approved order and shipment. Misuse, duplication, alteration, or use for unrelated property is prohibited.

You should retain carrier receipts and tracking information. Claims for loss or damage are subject to carrier rules, documentation requirements, coverage limits, and final decisions.

Seller representations.

By submitting or shipping an item, you represent and warrant that:

Prohibited and restricted items.

You may not submit or ship stolen, counterfeit, recalled, illegally modified, hazardous, contaminated, prohibited, or unlawfully possessed items.

You may not use WeBuyTools for firearms, ammunition, explosives, controlled substances, illegal surveillance devices, or any product prohibited by applicable law, carrier rules, Shopify policies, payment-provider rules, or our internal safety standards.

We may refuse, hold, report, surrender, return, or dispose of prohibited or suspicious items where permitted or required by law. We may cooperate with law enforcement, carriers, payment providers, insurers, or other appropriate parties.

Payments and seller payouts.

Approved seller payments are processed after inspection and final approval. Timing may vary depending on the selected payment method, verification requirements, weekends, holidays, banking delays, provider processing, or information needed to complete the payout.

You are responsible for providing accurate payout information. We are not responsible for delays or losses caused by incorrect information you provide, provider outages, banking restrictions, or circumstances outside our reasonable control.

We may delay, reverse, cancel, or withhold payment where reasonably necessary to investigate fraud, ownership concerns, duplicate payments, chargebacks, legal requirements, or violations of these terms.

You are responsible for taxes, reporting obligations, or other charges that apply to amounts you receive.

Buyer purchases.

Where buyer-facing purchases are available, product descriptions, condition information, prices, availability, shipping estimates, and checkout terms are displayed at or before purchase.

Used tools may show cosmetic wear, prior use, replaced parts, missing original packaging, or other characteristics consistent with the disclosed condition.

We may cancel or limit an order because of pricing errors, inventory issues, suspected fraud, payment failure, shipping restrictions, or other operational or legal concerns. If payment was collected for a cancelled order, the applicable amount will be returned through the original payment method, subject to provider processing times.

Buyer transactions may also be governed by additional marketplace, warranty, shipping, or return terms displayed during checkout or on the applicable policy page.

Returns, refunds, and transaction issues.

Returns, refunds, revised seller offers, declined offers, damaged shipments, and related transaction issues are governed by our Return and Refund Policy and Shipping Policy.

Nothing in these terms limits non-waivable rights that apply under consumer-protection law.

Fraud, misuse, and security.

You may not use the services to commit fraud, impersonate another person, manipulate prices or offers, submit false claims, interfere with website security, introduce malicious code, scrape protected content without permission, misuse shipping labels, or avoid account or transaction limits.

We may review transactions, preserve records, request verification, restrict features, cancel orders, suspend accounts, withhold property or funds where legally permitted, and report suspected unlawful activity.

Intellectual property.

The WeBuyTools website, branding, logos, design, software, text, graphics, databases, pricing presentation, and other content are owned by or licensed to WeBuyTools and are protected by intellectual-property laws.

You may use the website only for personal or authorized business transactions with WeBuyTools. You may not copy, reproduce, distribute, sell, reverse engineer, publicly display, or create derivative works from protected content without written permission.

Product names, trademarks, and logos belonging to third parties remain the property of their respective owners. Their appearance does not imply sponsorship or endorsement.

User content and feedback.

If you submit photographs, reviews, feedback, suggestions, or other content, you confirm that you have the right to provide it and that it does not violate another person’s rights.

You grant WeBuyTools a non-exclusive, worldwide, royalty-free license to use submitted content as reasonably necessary to operate, support, verify, improve, and promote the services, subject to our Privacy Policy and applicable law.

Service disclaimers.

To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free operation, permanent product availability, a particular offer amount, acceptance of any item, or a specific processing time.

Website prices, availability, descriptions, and content may contain errors or change without notice. We may correct errors and update information at any time.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

Limitation of liability.

To the fullest extent permitted by law, WeBuyTools and its owners, affiliates, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or loss of opportunity arising from the services.

To the fullest extent permitted by law, our total liability for a claim arising from a specific transaction will not exceed the amount paid or payable by WeBuyTools in connection with that transaction, or the amount you paid to WeBuyTools for the affected purchase.

Nothing in these terms excludes liability that cannot legally be excluded or limited.

Indemnification.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless WeBuyTools and its owners, affiliates, employees, contractors, and providers from claims, losses, liabilities, damages, costs, and expenses arising from your violation of these terms, unlawful conduct, inaccurate representations, misuse of the services, or infringement of another party’s rights.

Third-party services.

The services may rely on Shopify, payment processors, payout providers, carriers, analytics services, and other third parties. Their products and services may be governed by separate terms and privacy policies.

We are not responsible for third-party services or conduct outside our reasonable control, except where applicable law provides otherwise.

Suspension and termination.

We may suspend or terminate access, cancel orders, restrict transactions, or refuse service when we reasonably believe that a user has violated these terms, created legal or security risk, engaged in fraud or abuse, or used the services in a manner harmful to WeBuyTools or others.

Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limitations, indemnification, and dispute-related provisions—will continue to apply.

Governing law and disputes.

These terms are governed by the laws applicable in the jurisdiction where WeBuyTools is legally organized, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise.

Before filing a formal claim, you agree to contact us and make a reasonable good-faith effort to resolve the issue informally.

The appropriate governing-law, venue, arbitration, and class-action terms should be reviewed and finalized by qualified legal counsel based on the company’s legal entity and operating location.

Changes to these terms.

We may update these terms to reflect changes in our services, business practices, technology, or legal obligations.

The revised terms become effective when posted unless a different date is stated. When required by law, we will provide additional notice. Continued use of the services after the effective date means you accept the revised terms.

General provisions.

If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign your rights or obligations under these terms without our written consent. We may assign these terms in connection with a merger, financing, acquisition, restructuring, or transfer of our business.

These terms and incorporated policies constitute the entire agreement concerning the services, except for additional written terms that apply to a specific transaction or feature.
